Overview

Welcome to The Little Pioneers. The terms "we", "us" and "our" refer to The Little Pioneers (ABN 26 686 176 036). We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). The Little Pioneers is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them (these "Terms"), describe your rights and responsibilities when you use the Services.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.

Section 1 — Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Where any provision of these Terms would otherwise conflict with those rights, that provision does not apply to the extent of the conflict.

Section 2 — Access and account

By agreeing to these Terms, you represent that you are at least 18 years of age, and that you consent to any minor dependents using the Services on devices you own, purchase or manage.

To use the Services, including browsing our store or purchasing products, you may be asked to provide information such as your email address, billing, payment and shipping details. You represent that the information you provide is correct, current and complete.

You are responsible for maintaining the security of your account credentials and for activity on your account. You may not transfer, sell, assign or license your account to another person.

Section 3 — Our products

We make every effort to represent our products accurately. Colours and appearance may differ from how they appear on your screen, depending on your device and its settings.

Our stainless steel and silicone products may show light surface marks with normal use over time. This is ordinary wear and does not affect how the product performs.

Product descriptions may change at any time. We may discontinue any product, and may limit quantities offered to any person or region.

Nothing in this section limits your rights under Section 1.

Section 4 — Orders

When you place an order you are making an offer to purchase. We may accept or decline your order at our discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before an order is accepted.

Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests after an order is accepted. If we decline, change or cancel an order, we will attempt to contact you using the email address, billing address or phone number provided at the time of the order.

Returns and exchanges are governed by our Return & Refund Policy.

Section 5 — Preorders

Some products may be offered for preorder before stock arrives. Preorder items are charged at the time of purchase, not at dispatch.

Estimated dispatch dates are shown on the relevant product page and are estimates only. If an estimated dispatch date changes, we will notify you by email as soon as reasonably practicable. You may cancel a preorder for a full refund at any time before it is dispatched.

Section 6 — Prices, payment and billing

Prices, discounts and promotions may change without notice. The price charged will be the price in effect when the order is placed, as set out in your order confirmation email. Prices are in Australian dollars and include GST where applicable. Unless stated otherwise, posted prices do not include shipping.

We may offer promotions governed by separate terms. If those terms conflict with these Terms, the promotion terms govern.

Payment methods. We accept payment through Shopify Payments, PayPal and Afterpay, among other methods shown at checkout.

Afterpay. If you choose to pay using Afterpay, your instalment arrangement is a separate agreement between you and Afterpay, governed by Afterpay's own terms and conditions. We are not the provider of that arrangement and are not responsible for Afterpay's approval decisions, instalment scheduling, fees or account management. Afterpay minimum and maximum order values apply and are set by Afterpay. Refunds on Afterpay orders are processed through Afterpay in accordance with our Return & Refund Policy.

You agree to provide current, complete and accurate payment and account information, and to keep it up to date so we can complete your transactions and contact you as needed.

Section 7 — Shipping and delivery

We ship to Australia and New Zealand.

Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or events outside our reasonable control.

If your order does not arrive, or arrives damaged in transit, contact us and we will work with you to resolve it. Nothing in this section limits your rights under Section 1.

Section 8 — Errors, inaccuracies and omissions

Occasionally information in the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability.

We reserve the right to correct any errors and to change or update information, or to cancel an order, if information was inaccurate — including after you have submitted your order. If we cancel an order for this reason, we will refund you in full.

Section 9 — Intellectual property

Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement of them, are owned by The Little Pioneers, its affiliates or licensors, and are protected by Australian and international intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without our prior written consent.

The Little Pioneers' names, logos, product names, designs and slogans are our trademarks. You must not use them without our prior written permission. Shopify's name, logo and product names are trademarks of Shopify. All other names and marks on the Services belong to their respective owners.

Section 10 — Optional tools and third-party links

You may be given access to third-party tools that we do not monitor or control. These are provided "as is" and "as available", and your use of them is at your own risk. You should review the terms on which those tools are provided.

The Services may contain links to third-party websites. We are not responsible for the content or accuracy of third-party materials or sites, and you access them at your own risk. Complaints about third-party products or services should be directed to that third party.

Nothing in this section limits your rights under Section 1.

Section 11 — Relationship with Shopify

The Little Pioneers is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with The Little Pioneers. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Little Pioneers, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with The Little Pioneers.

Section 12 — Privacy

All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these policies.

Because the Services are hosted by Shopify, Shopify collects and processes information about your access to and use of the Services. Information you submit may be transmitted to Shopify and to third parties that may be located outside Australia. See our Privacy Policy for details.

Section 13 — Reviews and feedback

If you submit reviews, ideas, suggestions, feedback or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium, including for commercial use.

You represent that you own or have the necessary rights to the Feedback, that you have disclosed any compensation or incentive received in connection with it, and that it complies with these Terms.

We are not obliged to keep Feedback confidential, to pay for it, or to respond to it. We may remove Feedback we consider unlawful, offensive, misleading or otherwise objectionable.

Your Feedback must not infringe any third-party right, must not be defamatory, abusive or obscene, and must not contain malicious code. You must not use a false email address or misrepresent who you are. You are responsible for the accuracy of your Feedback.

Section 14 — Prohibited uses

You may access and use the Services for lawful purposes only. You must not use the Services:

  • for any unlawful or malicious purpose
  • to breach any applicable law or regulation
  • to infringe our intellectual property rights or those of others
  • to harass, abuse, defame, intimidate or harm any person
  • to transmit false or misleading information
  • to send unsolicited advertising or promotional material
  • to impersonate any person or entity
  • to upload viruses or malicious code
  • to reproduce, duplicate, copy, sell or resell any part of the Services
  • to collect or track the personal information of others
  • to spam, phish, spider, crawl or scrape
  • to interfere with or circumvent security features

We may suspend or terminate your account if we reasonably determine you have breached this section.

Section 15 — Termination

We may terminate this agreement or your access to the Services where you have breached these Terms, or where we reasonably consider termination necessary to protect our business, our customers or a third party. Where practicable, we will give you notice.

You remain liable for amounts due up to the date of termination. Termination does not affect any order already accepted, or any rights you have under Section 1.

Section 16 — Disclaimer and limitation of liability

This section is subject to Section 1 and does not limit any right or remedy you have under the Australian Consumer Law.

Information on the Services is provided for general information purposes. We do not warrant that the Services will be uninterrupted, timely, secure or error-free.

To the extent permitted by law, and other than as required by the Australian Consumer Law, we are not liable for indirect, incidental, special or consequential loss, including loss of profits, revenue, savings or data, arising from your use of the Services.

Where the Australian Consumer Law applies and our liability may lawfully be limited, our liability for a failure to comply with a consumer guarantee is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, paying the cost of replacing the goods, or paying the cost of having the goods repaired. This limitation does not apply where the goods are of a kind ordinarily acquired for personal, domestic or household use, and it is not fair or reasonable for us to rely on it.

Section 17 — Indemnity

To the extent permitted by law, you agree to indemnify us against losses, damages, liabilities and claims (including reasonable legal costs) payable to a third party arising from your breach of these Terms, your breach of any law or third-party right, or your misuse of the Services.

This indemnity does not apply to the extent the loss was caused or contributed to by us, and does not apply to any liability we have under the Australian Consumer Law.

Section 18 — General

Severability. If any provision of these Terms is unlawful, void or unenforceable, it is severed to the minimum extent necessary and the remaining provisions continue in force.

Waiver and entire agreement. Our failure to enforce any right or provision is not a waiver of it. These Terms, together with the policies posted on our site, are the entire agreement between you and us regarding the Services.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms to a purchaser of our business, provided your rights are not adversely affected.

Headings. Headings are for convenience only and do not affect interpretation.

Section 19 — Governing law

These Terms are governed by the laws of New South Wales, Australia. You and The Little Pioneers submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.

You can review the current version of these Terms at any time on this page.

We may update these Terms by posting changes to our website. We will notify you of material changes, and those changes will take effect on the date specified in the notice. Changes do not apply retrospectively to orders already accepted. Your continued use of the Services after changes take effect constitutes acceptance.
